Backdrop Alive Privacy Policy

This Privacy Policy explains how Abacus Brands, Inc. (“Company,” “we,” “our,” or “us”) collects, uses, shares, and protects your information when you use the Backdrop Alive App (“App”). By using the App, you agree to the terms outlined in this policy.

This App is intended for use only by and for adults.  If you are a minor, you should not use this App.  You should not use this App to collect information from any minor.

1. Information We Collect

If you are providing the App to other persons for use in connection with your AR enabled signage purchased from Backdrop.com or TradeShowBooth.com (a “Provider”), you are required to establish an account to use the App.  To establish an account, we collect your name, company, email, and purchase information relating to your signage.  In using the App, we collect information about each event at which you use it (name, location, dates), the games and activities you use at the event, and how you configure those games and activities.

If you were given the App to use by a Provider, we collect the information designated by the Provider.  This information may include your name, employer, email address, telephone number, title, prior attendance at a particular trade show or event, and similar survey information.  In addition, we collect information relating to each game or activity you engaged with through the App, such as which game you played, how many times you played, the results of your play, and how long you played.

In addition, we collect any images, videos, or other content you upload, along with images captured during AR interactions or related activities. We also track and collect engagement data, such as AR scans, triggered animations, AR enabled signage used, games played, prizes redeemed, or other participation levels. We also collect technical data, such as device type, operating system, browser, mobile carrier, IP address, and unique device identifiers (like IDFA, IDFV, or MAC address).

2. How We Use Your Information

We may use the information we collect to: operate, provide, improve and maintain the App; ensure the security of the App; send you information about the App, us, Backdrop.com, or TradeShowBooth.com which we believe you may be interested in; customize and/or personalize your experience; better respond to your inquiries; communicate with you about your service needs; and/or improve our business. 

3. How We Share Information

If you were given the App to use by a Provider and submitted information through the App, that information is given to the Provider.  We do not control how the Provider uses or shares your information.

We share your information when required to comply with legal obligations, such as responding to lawful requests, subpoenas, or court orders, or when we need to prevent fraud, investigate illegal activities, enforce our Terms, or protect the safety and rights of our users or others. In the event of a business change — such as a merger, acquisition, sale, bankruptcy, or reorganization — your information may be transferred as part of that transaction, in accordance with this policy.

Trusted service providers working on our behalf may access your information to perform tasks like hosting, analytics, app maintenance, email delivery, or customer support. These providers are contractually obligated to safeguard your data and are not allowed to use it for unrelated purposes. Internally, information may also be shared across Abacus Brands, Inc. and its affiliates (including Backdrop.com and TradeShowBooth.com) to help operate, maintain, and improve the App. In some cases, we may share aggregated or de-identified data with business partners to support joint offerings, analytics, or enhancements. This information does not identify you personally.

4. Data Security and International Transfers

We take reasonable measures to protect your information using industry-standard security practices. However, no computer or data system or transmission can be guaranteed as completely secure.  WE CANNOT AND DO NOT GUARANTEE THE SECURITY OR PRIVACY OF ANY INFORMATION YOU SUBMIT THROUGH THE APP.

Our services are operated in the United States and are governed by U.S. laws. By using the App, you acknowledge and agree that your information may be transferred to, stored, or processed in the United States or other countries where we or our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction, but we will take reasonable steps to ensure that your information is handled securely and in accordance with this Privacy Policy.

5. Data Retention

We retain personal information only as long as it is necessary to fulfill the purposes for which it was collected, to meet legal obligations, or as otherwise required by law. Event-specific data may be archived or deleted according to the policies of the event organizer managing that particular event.

6. Data Access or Deletion

Depending on your location, you may have the right to access, correct, or delete your personal data, request a copy of your information, or withdraw consent to certain types of processing.

7. California Consumer Notice and Disclosures (CCPA)

This section explains the rights of California residents under the California Consumer Privacy Act (“CCPA”) and how the App and Abacus Brands, Inc. (“Company,” “we,” “our,” or “us”) complies with those obligations. These rights apply to California residents with respect to personal information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a California consumer or household (“California Information”).

a. Your Rights Under the CCPA
 If you are a California resident, you have the right to request the following:

●      The categories of sources from which we collected California Information.

●      The business or commercial purpose for which we collected or disclosed California Information.

●      The categories of third parties with whom we shared California Information.

●      Whether we have sold or disclosed California Information for a business purpose.

b. Right to Opt-Out of Sale of Personal Information
We do not sell your personal information for direct marketing purposes. If this changes, we will provide a clear mechanism for you to opt out.

c. Right to Request Deletion
You have the right to request that we delete any California Information we collected from you, subject to certain legal exceptions.
